1. INTRODUCTION
This Personal Data Processing Information Text ("Information Text") has been prepared by the Data Controller PAWMAX EVİL HAYVAN MAMALARI A.Ş. ("Company" or "PawMax") in order to inform the data owner persons regarding the processing, storage and transfer of personal data of customers, potential customers, members, website visitors and third parties within the framework of the Company's activities arising from the legislation and legal regulations related to the Law on the Protection of Personal Data No. 6698 ("KVKK").
2. COLLECTION, PROCESSING AND PURPOSES OF PROCESSING PERSONAL DATA
The collected personal data will be processed in accordance with the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK for the purposes of carrying out the necessary work by the business units to benefit from the products and services offered by PawMax, to customize and recommend these products and services according to the tastes, usage habits and needs of the customers, to carry out financial and accounting transactions and communication activities, to ensure the legal and commercial security of PawMax and the persons who have a business relationship with PawMax, to determine and implement PawMax's commercial and business strategies. The relevant personal data is collected directly from the customers through sources such as PawMax website visits, memberships and purchases; purchases made through www.pawmax.pet, sharing in telephone or e-mail correspondence, workplace visits, CVs sent via the website or by other means such as e-mail, telephone etc. for job applications, physical or digital documents such as business cards, offers etc. sent through various means for commercial collaboration. In addition, data obtained indirectly from different channels, from (micro) websites used for web sites, blogs, competitions, surveys, games, campaigns and similar purposes, and from social media, e-bulletin reading or clicking movements, data provided by public databases, profiles and data open to sharing from social media platforms; can be processed and collected. In the event that customers purchase goods or services from PawMax or otherwise enter into a commercial or legal relationship with PawMax; primarily identity data (name, surname, TR identity number/passport number); communication data (e-mail address, address and telephone information, IP address), data regarding products purchased from stores within the scope of the Company's field of activity, shopping time information, information on campaigns and discounts utilized, visual and audio data obtained through security cameras located in stores for security purposes, store visit records are processed by PawMax within the framework of Article 5, paragraph 2 of the KVKK, within the scope of the establishment/performance of the contract, fulfillment of legal obligations and legitimate interests.
3. DATA PROCESSING METHODS AND DATA STORAGE PERIOD
Personal data regarding Data Owners may vary depending on the services provided by the Company and the Company's commercial activities; however, they may be collected verbally, in writing or electronically through automatic or non-automatic methods, through Company units and offices, website, social media channels, mobile applications and similar means. The relevant personal data may be processed as long as the Company's products and services are utilized. In addition, when the call centers or the website are used or the website is visited in order to utilize the Company's services, the relevant personal data may be processed when the Company's organizations are attended.
PawMax stores personal data for the period specified in the relevant laws and regulations, if required by these regulations. If no period is regulated in the legislation regarding how long personal data should be stored, personal data is stored for the period required to be stored in accordance with PawMax practices and industry practices, depending on the activity PawMax carries out while processing that data, and then deleted, destroyed or anonymized in accordance with PawMax's relevant policy, depending on the nature of the data.
If the purpose of processing personal data has ended; if the storage periods determined by the relevant legislation and PawMax have also expired; personal data may only be stored as evidence in possible legal disputes or for the purpose of asserting the relevant right related to personal data or establishing a defense. In establishing the periods herein, the storage periods are determined based on the statute of limitations for asserting the said right and the examples of previous requests made to PawMax on the same issues despite the expiration of the statute of limitations. In this case, the stored personal data is not accessed for any other purpose and access is provided to the relevant personal data only when it is necessary to use it in the relevant legal dispute.
4. PROTECTION OF PROCESSED PERSONAL DATA
The Company takes the necessary administrative and technical measures in accordance with Article 12 of the KVKK. The technical and administrative measures deemed necessary to preserve the personal data processed within the scope of the Company's activities in accordance with the KVKK and the relevant legislation are implemented within the framework of the necessary technological infrastructure, and in this direction, necessary inspections are carried out by taking precautions against data breach, unauthorized access, data loss, unauthorized modification of data and other threats.
5. TRANSFER OF PERSONAL DATA
The collected personal data may be transferred to our business partners, primarily Ticimax, which provides the Company's e-commerce infrastructure, our suppliers, cargo companies, PawMax authorities, our shareholders, legally authorized public institutions and private persons, domestic/overseas institutions and organizations with which we cooperate, within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK, for the purposes of carrying out the necessary work by the Company's business units to enable the relevant parties to benefit from the products and services offered by PawMax, customizing the products and services offered by PawMax according to the tastes, usage habits and needs of the customers and recommending them to the customers, ensuring the legal and commercial security of PawMax and the persons with whom PawMax has a business relationship, determining and implementing PawMax's commercial and business strategies.
6. LEGAL REASON FOR COLLECTING PERSONAL DATA
The relevant personal data is obtained in all kinds of verbal, written or electronic media, in line with the purposes stated above, in order to provide the products and services offered by the Company within the determined legal framework and to fulfill the Company's responsibilities arising from the contract and the law completely and correctly. Personal data collected for this legal reason can also be processed and transferred for the purposes specified in articles (1) and (5) of this text, in accordance with the General Principles listed in Article 4 of the KVKK, within the scope of the personal data processing conditions and purposes specified in articles 5 and 6 of the KVKK.
7. RIGHTS OF THE PERSONAL DATA OWNER Pursuant to Article 11 of the KVKK, data owners have the right to; (i) Learn whether or not their personal data is being processed,
(ii) Request information regarding the processing of personal data,
(iii) To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
(iv) To know the third parties to whom personal data is transferred, either domestically or abroad,
(v) Request correction of personal data if it is processed incompletely or incorrectly,
(vi) Request the deletion or destruction of personal data within the framework of the conditions set forth in Article 7 of the KVKK,
(vii) Request that the operations carried out pursuant to articles (v) and (vi) be notified to third parties to whom personal data has been transferred,
(viii) To object to the emergence of a result to the detriment of the person by analyzing the processed data exclusively through automatic systems,
(ix) In case of damages due to unlawful processing of personal data, the person has the right to demand compensation for the damages.
Data owners may submit written requests for improvement regarding the above-mentioned rights and other issues related to the protection of their data to the Company free of charge via the link www.pawmax.pet. The Company will finalize these requests within 30 (thirty) days.
Applications made to the Personal Data Protection Authority on relevant matters are subject to the Authority's fee schedule.
8. RIGHT TO CHANGE THE DATA OWNER’S PERMISSIONS REGARDING DATA PROCESSING
Regarding the permissions granted for the processing of personal data, you can make changes to your personal data processing permissions by calling Customer Services at 0 850 305 33 73.
