Warranty and Return Conditions

1. GENERAL

a. These conditions are related to the rights and obligations and possible claims that may arise after the sales contract of the "Buyer", who is the other party to the sales contract in online shopping made with PAWMAX EVİL ANIMAL MAMALARI A.Ş. ("Seller") through the website www.pawmax.pet.


b. If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and distance sales contract presented to you.

c. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation and other applicable laws regarding the sale and delivery of the product they purchase.

d. Each purchased product is delivered to the person and/or organization at the address indicated by the buyer.

e. The purchased product must be delivered complete and in accordance with the specifications specified in the order, and with documents such as the warranty certificate and user manual, if any.

2. IN CASE OF NON-PAYMENT OF THE PRICE OF THE PRODUCT PURCHASED

g. If the Buyer does not pay the price of the product purchased or cancels it in the bank records, the Seller's obligation to deliver the product ends. In case of non-payment, the Buyer cannot claim rights. 3. PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD

h. If, after the product is delivered, it is determined that the credit card used by the Buyer for payment has been used unfairly by unauthorized persons and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the contracted product to the Seller within 3 days, the shipping costs of which will belong to the Seller. 4. IN CASE OF FORCE MAJEURE i. Partial or general mobilization is declared, mobilization is declared in the city where the workplace, manufacturer or importer is located; extraordinary circumstances such as adverse weather conditions that cause a setback in work and prevent transportation, interruption of transportation, natural disasters such as rain, storm, earthquake, inundation, flood, fire, landslide, war, terror, riot, strike, lockout and similar situations, changing legislative provisions, significant failure in production and communication facilities, etc. are considered force majeure, including but not limited to these.

j. Circumstances such as infectious diseases, epidemics, COVID-19 etc.; Even if the workplace of the manufacturer, importer or seller is not closed or its activities are not restricted as a result of the different reflections of the virus; curfews, declaration of situations such as not being able to leave the house, quarantine of employees, quarantine of stores or workplaces of the manufacturer or importer, employees not coming to work, but not limited to these, will be considered force majeure.

k. If force majeure reasons that cannot be foreseen by the Seller occur and the product cannot be delivered on time, the situation will be notified to the Buyer. The Buyer may request the cancellation of the order, replacement of the product with a similar one or postponement of delivery until the obstacle is eliminated. If the Buyer cancels the order; if the payment was made in cash, this fee will be paid to the Buyer in cash within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels, the product fee will be returned to the bank within 14 days from the cancellation, but the bank is likely to transfer the amount to the Buyer's account within 2-3 weeks.

5. BUYER'S OBLIGATION TO CHECK THE PRODUCT:

l. The Buyer shall inspect the goods/services subject to the contract before receiving them; shall not accept goods/services that are damaged or defective such as crushed, torn packaging, etc. from the cargo company. The goods/services received shall be deemed to be undamaged and intact. The Buyer shall protect the goods/services meticulously after delivery. If the right of withdrawal is to be exercised, since opening the packaging of the products subject to the contract for hygiene reasons will render the product unusable and the relevant Regulation is in this direction, the goods/services shall not be used and shall be kept as received. The invoice shall also be returned together with the product.

6. USE OF THE RIGHT OF WITHDRAWAL:

m. If the Buyer wishes to withdraw from the sales contract, he/she may make a withdrawal notification by creating a request in the Return/Exchange section of the website within 14 (fourteen) days from the conclusion of the contract, provided that the relevant product is not among the "Products for which the Right of Withdrawal Cannot Be Used", without the obligation to show any reason.

n. In case of a notice of withdrawal, the customer is obliged to send the relevant product to the address “MERDİVENKÖY MAH. ŞAİR ARŞİ CAD. OSMANBEY APT NO: 35 B KADIKÖY/ İSTANBUL” via the contracted cargo company within 7 (seven) days from the notification.

7. WARRANTY CONDITIONS o. All products are under the warranty of the manufacturer unless otherwise stated. In order for the warranty conditions to be valid, be sure to check the product during cargo delivery. If you see any damage, do not accept the product by keeping a report. Situations resulting from abnormal use of the product and usage errors are not covered by the warranty. The warranty period starts from the invoice date, which is the delivery date of the products. If the product to be replaced under the warranty conditions is not still available at the Seller, the product will be replaced with an equivalent product determined by the Seller.

8. RETURN CONDITIONS

p. If the amount falls below the campaign limit set by the Seller due to the exercise of the right of withdrawal, the discount amount used within the scope of the campaign will be cancelled.

q. Products to be returned must be returned in the same condition as they were received, complete and undamaged, including the box and packaging. Otherwise, the seller will not accept the product back and will not refund the price. In case of damaged, missing, etc. returns, shipping costs etc. that may arise are the responsibility of the buyer.

r. If a promotional product was sent to the buyer by the seller along with the product, this promotion must also be returned. The invoice for the product must also be sent to the seller along with the product.

s. Expenses arising from the exercise of the right of withdrawal belong to the Seller. t. When the total price of the returned product/products is deducted from the total amount of the relevant order, and the remaining amount remains below 500 TL, which is FREE SHIPPING; the shipping fee is deducted from the return amount and the remaining amount is refunded. u. In products where a shipping fee is charged for cancellation and return, only the product price is refunded to the customer, the shipping fee collected from the customer is not refunded to the customer.

v. If it is done properly, the provisions of this article are also valid for partial returns. w. After the return process is completed; if the buyer has paid by credit card, the refund will be reported to the buyer's bank within 2 (two) business days. Refunds for credit card returns are made according to the bank rules. If the purchase is made in installments, the bank may make this refund in installments every month. x. If other payment channels have been used, the amount paid for the product will be refunded to the buyer's account within 2 (two) business days from the cancellation process.

9. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

y. It is not possible to return products that are prepared at the request of the Buyer or clearly in line with their personal needs and are not suitable for return, single-use products, goods that are in danger of rapid deterioration or whose expiration date is likely to pass, products that are not suitable for return in terms of health and hygiene if the packaging is opened by the Buyer after delivery to the Buyer, products that are mixed with other products after delivery and cannot be separated by their nature, services performed instantly in an electronic environment or intangible goods delivered to the consumer instantly, and audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, if the packaging is opened by the Buyer, as per the Regulation. z. In this context, it is not possible to return or exchange cat toilet products, including those that have not been opened, products that are prone to contamination such as nail clippers, brushes, combs, disposable products, products that have an expiration date after being opened such as eye and ear drops, briefs and pads, and any product that is not suitable for return in terms of hygiene conditions, even if not listed here. It is not possible to exchange or return the product called Name Tags and Barking Preventive Training Collar.
